By accessing or using the BeMyBuddi website, applications, and related services (collectively, the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the Service.

We may update these Terms from time to time. Continued use of the Service after changes are posted constitutes acceptance of the revised Terms. We encourage you to review this page periodically.

All characters on BeMyBuddi are entirely fictional and AI-generated. No character represents, depicts, or is based on any real person, living or deceased. Any resemblance to real individuals is purely coincidental and unintentional.

Characters are not real people. They do not have real feelings, opinions, or consciousness. Interactions with characters do not constitute a real relationship of any kind. Content generated by characters is produced by artificial intelligence and does not reflect the views, beliefs, or statements of any human being.

Character names, likenesses, backstories, and personalities are works of fiction created for entertainment purposes. BeMyBuddi makes no representation that any character is or was a real person.

You must be at least 18 years of age to use the Service. By creating an account or using the Service, you represent and warrant that you are at least 18 years old and have the legal capacity to enter into these Terms.

We require users to affirmatively confirm their age before accessing interactive features. We reserve the right to terminate, without notice, any account that we reasonably believe belongs to a person under 18 years of age.

We comply with the Children's Online Privacy Protection Act (COPPA) and equivalent international regulations. We do not knowingly collect personal information from anyone under 18. If we discover that a minor has used our Service, we will promptly delete their account and all associated data.

Interactions with BeMyBuddi characters are for entertainment and companionship purposes only. BeMyBuddi does not provide therapy, counseling, mental health services, or medical advice of any kind.

Characters are not a substitute for human relationships, professional support, or medical treatment. You should not rely on interactions with characters for emotional support during a crisis.

If you or someone you know is experiencing a mental health emergency, please contact a qualified professional or call a crisis helpline such as the 988 Suicide and Crisis Lifeline (call or text 988 in the US) or the Crisis Text Line (text HOME to 741741).

BeMyBuddi is not liable for emotional attachment, dependency, or distress that may develop from use of the Service.

You agree that you will not use the Service to:

• Generate, request, or distribute content involving minors in any form, including but not limited to sexual, violent, or exploitative content.
• Attempt to extract personal information from characters (they have none — they are AI-generated fiction).
• Engage in harassment, threats, hate speech, or any form of abuse directed at other users, the Service, or its operators.
• Use the Service for any illegal activity or in violation of any applicable law or regulation.
• Attempt to reverse-engineer, exploit, or compromise the Service's security, infrastructure, or AI systems.
• Misrepresent your identity, age, or affiliation in connection with the Service.

We reserve the right to terminate accounts that violate these terms immediately, without notice or refund.

The Service offers free and paid tiers. Paid subscriptions auto-renew at the end of each billing cycle unless cancelled before the renewal date through your account settings.

All purchases, subscriptions, and payments made through the Service are final and non-refundable. By completing a purchase you acknowledge and agree that you will not receive a refund or credit for any reason, including dissatisfaction, accidental purchases, or unused subscription time.

We reserve the right to modify pricing and subscription tiers at any time. Changes take effect at the start of your next billing cycle. Continued use of the Service after a pricing change constitutes acceptance.

If your account is suspended or terminated for a violation of these Terms, you will not receive a refund for any remaining subscription period. Upon cancellation, your data will be retained for a reasonable period to allow reactivation, after which it may be permanently deleted.

All content, code, designs, AI models, character likenesses, names, and materials on the Service are the property of BeMyBuddi or its licensors. You may not reproduce, distribute, or create derivative works from any part of the Service without prior written consent.

Messages you send are your content. By using the Service, you grant BeMyBuddi a non-exclusive, worldwide, royalty-free license to process and store your messages solely for the purpose of providing and improving the Service.

The Service is provided on an "as is" and "as available" basis without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

BeMyBuddi is not responsible or liable for:

• Decisions you make based on conversations with characters.
• Emotional distress or dependency arising from use of the Service.
• Technical outages, interruptions, or data loss.
• Changes to character behavior, personality, appearance, or availability — characters may be updated, modified, or discontinued at any time without notice.
• Any damages arising from unauthorized access to or alteration of your transmissions or data.

To the fullest extent permitted by applicable law, BeMyBuddi's total liability for any claims arising under these Terms shall not exceed the amount you paid to BeMyBuddi in the twelve (12) months preceding the claim.

You agree to indemnify, defend, and hold harmless BeMyBuddi, its officers, directors, employees, and agents from any claims, liabilities, damages, losses, and expenses (including reasonable attorney's fees) arising from your use of the Service or violation of these Terms.

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions.

Any disputes arising from these Terms or the Service shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association, except where prohibited by law.

We may suspend or terminate your access to the Service at any time, for any reason, including violation of these Terms, without prior notice or liability.

You may terminate your account at any time by contacting us. Upon termination, your right to use the Service ceases immediately. We may retain certain data as required by law or legitimate business purposes.

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.
